Moving from Ukraine to Spain in 2026: Temporary Protection, Work and Long-Term Residence

Ukrainians displaced by the war may qualify for temporary protection in Spain, providing legal residence, permission to work, healthcare access, education for children and other rights without completing the ordinary asylum process.

A major change has now been confirmed: EU temporary protection for displaced people from Ukraine has been legally extended until 4 March 2028.

Spain has also introduced important rules allowing qualifying temporary-protection beneficiaries to transition into ordinary Spanish residence permits, arraigo and long-term residence.

This means that for many Ukrainians who have already built a life in Spain, the question is no longer only “How do I obtain temporary protection?”

It is increasingly:

“What should my long-term immigration status in Spain be?”

Temporary Protection Has Now Been Extended Until March 2028

This is the most important update to the page.

Temporary protection for qualifying displaced people from Ukraine has now been formally extended until:

4 March 2028

The extension continues the EU emergency protection framework originally activated in 2022.

For beneficiaries, temporary protection provides rights including:

  • residence;
  • employment;
  • self-employment;
  • healthcare;
  • education for children;
  • vocational training;
  • social and reception assistance under applicable conditions;
  • family reunification in qualifying circumstances.

Temporary protection remains distinct from ordinary Spanish immigration residence and from international protection or refugee status.

Temporary Protection Until 2028 vs TIE Validity

This distinction is extremely important.

There are two different issues:

Temporary-protection status

and

the expiry date printed or legally recognized for your physical TIE.

The EU legal framework now extends temporary protection until 4 March 2028.

Spain’s currently published automatic extension for temporary-protection TIE cards extends their validity through:

4 March 2027

Therefore, do not assume that temporary protection itself ends in 2027 simply because the current Spanish TIE extension ends then.

Spain may need to issue further card-related instructions to reflect the 2028 extension.

Check the current rules before requesting a replacement TIE solely because of the printed expiry date.

Important New Rule for Certain Applicants From 31 July 2026

The 2026 EU extension introduced a new condition concerning Ukrainian military obligations.

For certain people seeking temporary protection after the new rule took effect, authorities may require evidence showing that applicable Ukrainian military obligations have been satisfied.

Depending on the person’s circumstances, relevant evidence may include proof that departure from Ukraine was lawful or official documentation establishing compliance or exemption.

However, there is an extremely important protection for existing beneficiaries.

The new requirement does not apply to people who were already beneficiaries of temporary protection in a particular EU Member State on or before 30 July 2026 and who continue to hold that protection there without interruption.

This means the new rule should not be interpreted as requiring every Ukrainian already living under temporary protection in Spain to re-prove military status.

Who Can Qualify for Temporary Protection in Spain?

Temporary protection is not based solely on possession of a Ukrainian passport.

Spain’s framework covers several categories.

These include qualifying:

  • Ukrainian nationals who were resident in Ukraine before 24 February 2022;
  • family members covered by the protection framework;
  • Ukrainian nationals who were already in Spain before the invasion and cannot return to Ukraine;
  • stateless persons and third-country nationals who benefited from international or equivalent national protection in Ukraine;
  • certain third-country nationals who legally resided in Ukraine and cannot safely and permanently return to their country or region of origin.

Individual eligibility must still be established.

Does Every Ukrainian Citizen Automatically Receive Temporary Protection?

No.

Ukrainian nationality is highly relevant, but the applicant must still fall within the applicable temporary-protection categories.

Authorities can examine:

  • nationality;
  • previous residence in Ukraine;
  • date and circumstances of displacement;
  • family relationships;
  • previous protection status;
  • residence documentation;
  • other eligibility requirements.

This becomes particularly important for people who have spent significant periods living permanently outside Ukraine.

What Documents Are Needed?

Depending on the applicant, useful documents can include:

  • Ukrainian passport;
  • Ukrainian national ID;
  • other travel document;
  • birth certificates;
  • marriage certificate;
  • children’s documents;
  • documents proving family relationships;
  • Ukrainian residence documents;
  • documents proving previous legal status in Ukraine;
  • documentation relevant to military obligations where the new rule applies.

Preserve copies of every immigration document you receive.

What Happens When You Apply?

The temporary-protection procedure is generally completed personally through the designated Spanish authorities.

Once the application is registered, the applicant receives identifying information including an:

NIE — Número de Identidad de Extranjero

After approval, the protection resolution confirms the person’s residence and work authorization.

Keep the resolution permanently in your immigration file.

It may later become important for:

  • employment;
  • TIE procedures;
  • Social Security;
  • healthcare;
  • residence modification;
  • long-term residence;
  • proving historical legal residence.

NIE, TIE and Temporary Protection: What Is the Difference?

These terms are frequently confused.

NIE

The NIE is your foreigner identification number.

It is used throughout Spanish administration.

An NIE is not independently a residence permit.

Temporary-Protection Resolution

This is the administrative decision establishing your protected immigration status.

It provides the underlying residence and work rights.

TIE

The Tarjeta de Identidad de Extranjero is the physical residence identity card.

The application procedure for a normal TIE generally uses Form EX-17.

Therefore:

NIE = number

Temporary-protection resolution = immigration authorization

TIE = physical residence card

Can Ukrainians Work in Spain Under Temporary Protection?

Yes.

Temporary protection authorizes qualifying beneficiaries to work in Spain.

This includes:

  • employment for a Spanish company;
  • qualifying self-employment;
  • professional activity.

A separate ordinary work visa is not required simply to exercise the employment rights already included in valid temporary protection.

However, the work itself must still be registered correctly.

NIE Is Not Enough to Start Working

Having an NIE does not prove that your employment has been correctly registered.

An employee generally also needs a Spanish Social Security number, and the employer must complete the relevant alta with Social Security.

The distinction is:

NIE → foreigner identification

NUSS → Social Security identification

Alta → actual employment registration

Check Your Social Security Registration

Do not rely only on an employer saying:

“Everything is registered.”

Verify your Spanish employment record.

Your Social Security information can help confirm:

  • employment start date;
  • employer;
  • Social Security regime;
  • registration status;
  • contribution periods.

Maintaining accurate employment records becomes increasingly important if you later transition to ordinary Spanish residence or apply for long-term residence.

Can Ukrainians Become Autónomos?

Yes.

Temporary-protection beneficiaries with work rights can potentially establish self-employed activity.

However, becoming an autónomo involves separate registrations with:

  • the Spanish Tax Agency;
  • Social Security;
  • RETA;
  • other authorities where relevant.

It can also create:

  • monthly Social Security contributions;
  • invoicing requirements;
  • VAT obligations;
  • income-tax filings;
  • quarterly returns;
  • accounting obligations.

Do not register as autónomo simply because someone says it will “help immigration.”

There should be genuine professional or business activity.

Healthcare for Ukrainians in Spain

Temporary protection provides access to medical assistance in Spain.

The practical healthcare-registration process is managed regionally.

The procedure can therefore differ between:

  • Valencian Community;
  • Madrid;
  • Catalonia;
  • Andalusia;
  • Murcia;
  • other autonomous communities.

Documents may include your:

  • passport;
  • temporary-protection resolution;
  • TIE;
  • NIE;
  • padrón;
  • healthcare-entitlement information.

Healthcare Registration Is Separate From Getting an NIE

Another common misunderstanding is:

NIE → automatic healthcare card

That is not the complete process.

The practical sequence can look more like:

Temporary protection → healthcare entitlement → local address → regional healthcare registration → health card

Requirements vary according to circumstances and region.

Children and Schools in Spain

Children covered by temporary protection can access education in Spain.

School administration is partly regional, which means families should investigate the system in the autonomous community where they live.

Documents may include:

  • passport or identity document;
  • birth certificate;
  • TIE;
  • protection resolution;
  • padrón;
  • previous school reports;
  • vaccination documentation;
  • custody documents.

Location matters considerably.

Children studying in some parts of Spain may encounter regional languages including:

  • Catalan;
  • Valencian;
  • Basque;
  • Galician.

Families should investigate school catchment areas and teaching languages before signing a long-term rental contract.

Empadronamiento for Ukrainians Living in Spain

Once you establish your normal home, register your address with the municipality.

This is called:

empadronamiento

or registration on the padrón municipal.

The padrón can be relevant for:

  • healthcare;
  • education;
  • municipal services;
  • social support;
  • immigration procedures;
  • proving residence history.

Opening a Spanish Bank Account

Temporary-protection beneficiaries can open Spanish bank accounts subject to each institution’s identity and compliance procedures.

Banks may request:

  • passport;
  • NIE;
  • TIE;
  • residence resolution;
  • Spanish address;
  • employment evidence;
  • source-of-funds information;
  • tax-residence declaration.

Finding Housing

Finding a long-term rental can sometimes be more difficult than completing immigration registration.

Landlords may request:

  • employment contract;
  • payslips;
  • bank statements;
  • benefits documentation;
  • deposit;
  • additional guarantee;
  • rental-insurance approval.

Before paying money, verify:

  • identity of the landlord;
  • ownership;
  • rental contract;
  • property address;
  • payment purpose;
  • whether the accommodation can genuinely be used as your home;
  • whether padrón registration can be completed.

Do not transfer a deposit merely because somebody sends photographs and a passport copy through WhatsApp.

Can Ukrainians Travel Around the EU?

Holding Spanish temporary protection does not mean you can establish full temporary-protection rights simultaneously throughout the European Union.

A beneficiary with appropriate Spanish residence documentation can generally make qualifying short visits elsewhere in the Schengen Area.

But:

Spanish temporary protection → residence rights in Spain

does not mean:

automatic permanent residence and employment rights in every other EU country.

Temporary protection can normally be fully exercised in only one Member State at a time.

Can You Move Temporary Protection to Another EU Country?

Potentially, but the Spanish status should be dealt with correctly.

A person moving permanently to another participating country should normally:

  1. Confirm eligibility there.
  2. Renounce Spanish temporary protection where required.
  3. Keep evidence of the renunciation.
  4. Register in the destination country.

Do not simply register simultaneously in several countries.

The 2026 EU rules have strengthened the importance of avoiding multiple active registrations.

Can You Visit Ukraine and Return to Spain?

A short visit to Ukraine is different from permanent return.

Before travelling, make sure you have appropriate documentation, potentially including:

  • valid passport or travel document;
  • TIE;
  • temporary-protection resolution;
  • evidence of the applicable TIE extension if relevant.

The TIE itself is not a passport.

People with unusual documentation, expired cards or pending immigration changes should check their re-entry position before travelling.

Returning Permanently to Ukraine

A permanent move back to Ukraine can require more than buying a one-way ticket.

Depending on your circumstances, you may need to update:

  • temporary-protection status;
  • Social Security;
  • employment;
  • autónomo registration;
  • Spanish Tax Agency information;
  • healthcare;
  • padrón;
  • benefits;
  • banking.

Keep evidence of any formal renunciation or deregistration.

Ukrainian Driving Licence in Spain

This is an important section missing from the current Newcomer page.

Valid Ukrainian driving licences benefit from special recognition connected with temporary protection.

Qualifying beneficiaries can use valid Ukrainian licences under the applicable temporary-protection rules without being required simply because of relocation to provide the ordinary sworn translation or International Driving Permit normally associated with some third-country licences.

Ukraine also has a driving-licence exchange arrangement with Spain.

For ordinary eligible motorcycle and passenger-car categories, qualifying licences may generally be exchangeable without taking the normal Spanish theory and practical tests.

The licence must satisfy the conditions applicable to the exchange.

This can make the Ukrainian situation substantially different from moving to Spain with a licence issued by a country that has no exchange agreement.

The Most Important 2026 Change: Moving From Temporary Protection to Ordinary Residence

Spain introduced a very important legal development in 2026.

Temporary-protection beneficiaries now have clearer pathways to transition into other Spanish residence authorizations when they meet the requirements.

Potential routes can include:

  • residence and work authorization;
  • arraigo;
  • qualifying family residence;
  • highly qualified professional residence;
  • certain International Mobility Act authorizations;
  • other residence categories that can legally be requested from Spain.

Temporary protection therefore does not necessarily need to remain a person’s only immigration status indefinitely.

Transition to a Spanish Work Residence Permit

Someone who has built stable employment in Spain may potentially qualify to move into an ordinary residence and work authorization.

Employment alone does not guarantee approval.

The applicant and employer must satisfy the requirements of the selected immigration route.

Highly Qualified Ukrainians Working in Spain

Professionals in areas such as:

  • technology;
  • engineering;
  • management;
  • finance;
  • science;
  • research;
  • specialist consulting;

may potentially qualify under Spain’s International Mobility framework when the job, salary, qualifications and employer satisfy the requirements.

This can be particularly interesting for people who have established a long-term professional future in Spain and want to move away from an emergency protection status.

Remote Workers

Some temporary-protection beneficiaries working remotely for companies outside Spain may potentially qualify for another immigration route where the relevant conditions are met.

However, changing immigration status should not be done solely because another permit sounds more attractive.

Consider:

  • employment stability;
  • Social Security;
  • tax consequences;
  • family rights;
  • renewal conditions;
  • long-term residence;

Temporary Protection and Arraigo

Spain’s 2026 rules introduced an especially important clarification.

Time spent in Spain under temporary protection can count toward the continuous-presence requirement relevant to arraigo.

The current immigration framework generally uses a two-year continuous-presence requirement for the main qualifying arraigo routes.

Temporary-protection beneficiaries do not have to pretend those years in Spain never existed.

Depending on individual circumstances, possible routes may include different forms of arraigo.

Temporary Protection Can Count Toward Five-Year Long-Term Residence

This is potentially one of the most important immigration developments for Ukrainians who have been living in Spain since the early years of the war.
