EX-07 Form Spain: Self-Employed Residence and Work Permit

EX-07 is Spain’s official immigration form for temporary residence and self-employed work, known as residencia temporal y trabajo por cuenta propia. It is primarily used by qualifying non-EU nationals who want to move to Spain to operate their own business, practise a profession, provide independent services or work as an autónomo.

EX-07 is not simply an autónomo-registration form.

For a standard first-time applicant living outside Spain, it forms part of an immigration process in which the applicant must demonstrate that the proposed activity is lawful, professionally viable and supported by sufficient investment.

The initial authorization is generally valid for one year and is normally limited to a specific Autonomous Community and sector of activity.

What Is Form EX-07?

EX-07 is officially used for:

Solicitud de autorización de residencia temporal y trabajo por cuenta propia

or an application for temporary residence and self-employed work authorization.

In Spain, self-employed work is called:

trabajo por cuenta propia

A person registered for self-employed activity is commonly known as an:

autónomo

The immigration authorization and registration as an autónomo are connected, but they are not the same procedure.

EX-07 deals with immigration permission.

Autónomo registration involves Spanish tax and Social Security systems after the appropriate right to work has been established.

Who Can Use EX-07?

EX-07 can be appropriate for qualifying non-EU nationals who want to establish a genuine self-employed economic activity in Spain.

Examples can include:

  • consultants;
  • designers;
  • photographers;
  • tradespeople;
  • repair specialists;
  • beauty professionals;
  • architects;
  • certain healthcare professionals;
  • independent technology professionals;
  • language professionals;
  • shop owners;
  • restaurant or café operators;
  • craftspeople;
  • independent service providers;
  • other small-business owners.

The applicant must be legally and professionally capable of carrying out the proposed activity.

Simply saying:

“I want to become autónomo”

is not enough.

The immigration authorities assess the underlying economic project.

Who Normally Does Not Need EX-07?

EX-07 is not the standard form for every foreigner who wants to work independently in Spain.

Different procedures can apply to:

  • EU, EEA and Swiss citizens;
  • family members with an existing right to work;
  • Digital Nomad Visa holders;
  • highly qualified professionals;
  • entrepreneurs qualifying under Spain’s international-mobility framework;
  • people modifying another Spanish residence status;
  • people with exceptional-circumstances residence;
  • foreign nationals who already hold unrestricted work rights.

The immigration route should therefore be selected before preparing EX-07.

EX-07 vs Autónomo Registration

These are different processes.

EX-07

EX-07 concerns your immigration authorization to reside and carry out qualifying self-employed work.

Autónomo Registration

Autónomo registration concerns your operational status within the Spanish tax and Social Security systems.

A person may need to coordinate:

Immigration authorization → Entry into Spain → Social Security → Tax registration → Autónomo activity

Having an NIE alone does not authorize self-employment.

Likewise, obtaining a tax number does not replace immigration permission.

EX-07 vs Digital Nomad Visa

These two routes are frequently confused.

EX-07 — Cuenta Propia

EX-07 is primarily designed for someone establishing or conducting a genuine self-employed economic activity under Spain’s general immigration regime.

It can be appropriate where the applicant intends to:

  • establish a Spanish business;
  • serve the Spanish market;
  • operate local commercial premises;
  • practise a profession in Spain;
  • build an independent economic activity in Spain.

Digital Nomad Visa

Spain’s Digital Nomad regime is principally designed for qualifying international remote workers whose work is connected mainly with companies or clients outside Spain.

Someone who already operates an established international freelance activity should therefore compare the two options carefully.

EX-07 vs Owning a Spanish Company

Foreigners can own businesses or shares in Spain without automatically gaining the right to live and work here.

Three separate questions should be considered:

  1. Can you own the company?
  2. Can you legally reside in Spain?
  3. Can you personally work for or manage the company?

Company ownership does not itself grant residence or work authorization.

Main Requirements for Initial EX-07

A standard initial self-employed residence and work application requires more than a passport and business idea.

The applicant must generally demonstrate several different elements.

Immigration Eligibility

The applicant must satisfy the general immigration conditions applicable to the procedure.

These include matters such as:

  • not falling under the EU free-movement regime;
  • not being irregularly present in Spain;
  • not having disqualifying criminal convictions;
  • not being prohibited from entering Spain;
  • not being subject to an applicable voluntary-return no-return commitment;
  • not representing a threat to public order, security or public health.

Legal Requirements for the Activity

The proposed business or professional activity must comply with the requirements that also apply to Spanish nationals carrying out the same activity.

Depending on the project, this may involve:

  • municipal licences;
  • opening licences;
  • responsible declarations;
  • prior communications;
  • professional authorizations;
  • sector-specific registrations;
  • health permits;
  • other regulatory requirements.

The exact requirements depend on the business.

A consultant working from an office may have very different requirements from someone opening a restaurant.

Professional Qualifications

Where qualifications are legally required for the proposed profession, the applicant must demonstrate that they satisfy those requirements.

Evidence may involve:

  • professional qualifications;
  • diplomas;
  • vocational certificates;
  • professional experience;
  • homologation;
  • recognition of foreign qualifications;
  • membership of a professional body.

This is particularly important for regulated professions.

Immigration approval does not allow someone to bypass professional licensing rules.

Sufficient Investment

The applicant must demonstrate that the planned investment is sufficient for the proposed activity.

There is no single universal minimum investment amount that applies to every EX-07 application.

A freelance consultant working remotely may require comparatively little startup capital.

A restaurant, shop or physical-service business may require substantially more.

The correct question is therefore not:

“What is the minimum amount for EX-07?”

but:

“Is my proposed investment realistic for the business I intend to operate?”

Employment Creation

The authorities can also consider the effect of the project on employment creation.

Importantly, Spanish rules recognize self-employment itself as relevant employment creation.

This does not mean that every EX-07 applicant must hire Spanish employees.

A viable project operated by the applicant alone can still qualify where the other requirements are satisfied.

Is a Business Plan Required for EX-07?

The immigration authorities need enough evidence to understand whether the proposed economic activity is realistic and sufficiently funded.

A detailed business or professional plan is therefore extremely useful even though the key legal requirement is proving matters such as the activity, investment, qualifications and required authorizations.

A strong project plan should explain:

  • what the business will do;
  • products or services;
  • target customers;
  • market;
  • location;
  • pricing;
  • expected revenue;
  • expected costs;
  • startup investment;
  • equipment;
  • premises where applicable;
  • marketing strategy;
  • professional background;
  • projected profitability.

Financial projections should be realistic and internally consistent.

What Should the Financial Plan Show?

The financial section should explain how much money is needed to start and operate the activity.

Depending on the business, this can include:

  • equipment;
  • inventory;
  • premises;
  • deposit and rent;
  • professional fees;
  • licences;
  • insurance;
  • technology;
  • website costs;
  • marketing;
  • vehicles;
  • utilities;
  • initial working capital.

The investment claimed in the application should make sense for the activity described.

Does EX-07 Have an IPREM Minimum Investment?

No fixed statutory EX-07 investment can be calculated simply by multiplying IPREM.

This is different from immigration routes where the law provides a direct income formula.

EX-07 focuses on whether the planned investment is sufficient for the actual project.

Applicants should therefore be cautious with websites claiming that every self-employed application requires exactly the same investment amount.

Can an External Organization Assess the Project?

Spanish immigration guidance recognizes that professional qualifications, investment and the employment impact of a project may be supported through an assessment from recognized self-employed or business organizations.

Such an assessment can strengthen the evidence, but it is not the only legally acceptable way to demonstrate the requirements.

The underlying documents should still support the actual activity.

Commercial and Professional Licences

Licensing requirements depend heavily on what the applicant plans to do.

For some small retail and service activities carried out in qualifying premises, a declaración responsable or prior communication may be relevant.

Other activities can require specific authorizations or licences.

The application may need to show:

  • which licences are required;
  • which applications have already been submitted;
  • what stage the licensing process has reached.

Do not sign an expensive long-term commercial lease before understanding whether the planned activity can legally operate from the premises.

What Information Does EX-07 Ask For?

The current form is divided into several principal sections.

Foreign Worker Details

The first section asks for personal information such as:

  • passport;
  • NIE if already assigned;
  • surname;
  • name;
  • sex;
  • date of birth;
  • country and place of birth;
  • nationality;
  • marital status;
  • parents’ names;
  • Spanish address where applicable;
  • telephone;
  • email;
  • legal representative;
  • dependent school-age children in Spain.

The details should match the applicant’s identity documents exactly.

Activity Details

This section identifies the proposed economic activity.

It includes information such as:

  • business or trading name where applicable;
  • NIF or NIE;
  • activity;
  • CNAE;
  • business address;
  • province;
  • telephone;
  • email.

The activity entered here should be consistent with the business documentation and project description.

Representative Information

Where another person is legally authorized to act in relation to the application, the relevant representation information is included.

Address for Notifications

The form also contains an administrative-notifications section.

This is important because immigration communications can include:

  • requests for additional documents;
  • resolutions;
  • deadlines;
  • procedural notices.

What Procedures Does the Current EX-07 Cover?

EX-07 is broader than only the ordinary first-time self-employed authorization.

The current form includes several options.

Initial Self-Employed Residence

This is the standard route for a qualifying applicant resident outside Spain.

International Agreement Cases

The form includes a specific initial option for nationals covered by applicable international agreements, including the special framework involving Andorra.

Self-Employed Cross-Border Worker

EX-07 can also be used for a qualifying trabajador transfronterizo por cuenta propia.

This is a specialist authorization for someone residing in the border area of a neighboring state and returning there under the applicable cross-border-worker framework.

It should not be confused with ordinary self-employed residence in Spain.

Renewal

EX-07 is used to renew temporary self-employed residence and work authorization.

The current form distinguishes between:

  • continuation of the self-employed activity;
  • other legally recognized renewal circumstances.

Territorial Expansion

The current EX-07 also contains an option for ampliación del ámbito territorial where the same activity is carried out in several Autonomous Communities under the applicable rules.

This is relevant because an initial authorization is normally geographically limited.

Where Is the Initial EX-07 Application Submitted?

For the ordinary initial route, the foreign applicant submits the application personally through the Spanish Consular Office corresponding to their place of residence abroad.

This is a major difference from immigration procedures that begin electronically through Mercurio inside Spain.

The ordinary initial EX-07 route should therefore not be described as an online application from Spain.

Can You Apply for Initial EX-07 as a Tourist in Spain?

The standard initial procedure is intended for a foreign national who is not resident in Spain and is initiated through the relevant Spanish consular office abroad.

A person already living legally in Spain under another status may potentially have a modification pathway, but that is a different immigration procedure.

Do not assume that entering as a tourist allows you to submit the normal initial EX-07 inside Spain.

Documents Commonly Required for EX-07

The exact application depends on the proposed business or profession.

Common documentation can include:

  • completed EX-07;
  • full valid passport or travel document;
  • criminal-record documentation;
  • professional qualifications;
  • evidence of experience;
  • homologation or recognition where required;
  • professional-registration evidence;
  • licensing documentation;
  • responsible declaration or prior communication where applicable;
  • evidence of planned investment;
  • supporting project documentation;
  • evidence concerning potential employment creation;
  • translations;
  • apostilles or legalization where required.

The application should be internally consistent.

The activity described on EX-07 should match the evidence relating to investment, licences, qualifications and business operations.

Criminal Record Requirements

The initial procedure requires appropriate criminal-record evidence concerning relevant countries of previous residence.

Foreign criminal-record certificates can require:

  • apostille;
  • legalization;
  • sworn translation.

Applicants should prepare these documents early because obtaining and authenticating them can take time.

Foreign Documents and Sworn Translation

Foreign public documents submitted in an EX-07 application may require authentication.

Depending on the issuing country, this can involve:

  • Hague Apostille;
  • consular legalization;
  • an exemption under an international agreement.

Foreign-language documents may also require translation by an authorized sworn translator.

Professional qualifications and corporate documents should be checked particularly carefully.

EX-07 Fees

The initial procedure generally involves both residence and work fees.

Modelo 790 Código 052

The applicant pays the residence fee under the applicable category for the initial residence and work authorization.

Modelo 790 Código 062

A work-authorization fee also applies under the relevant self-employed category where the authorization duration meets the applicable threshold.

The fees become due when the immigration application is submitted and should be paid within the applicable deadline.

How Long Does Initial EX-07 Processing Take?

The official maximum decision period for the standard initial self-employed authorization is generally three months.

The period runs from the day after the application enters the register of the authority responsible for processing it.

If no decision is notified within the statutory period, the standard initial application can be treated as refused through negative administrative silence.

The actual process can take longer overall because the visa, entry and post-arrival stages are separate.

What Happens After Initial EX-07 Approval?

Approval of the residence and self-employed work authorization is not the end of the process.

Several stages follow.

Apply for the Visa

After approval, the applicant generally has one month from notification to personally apply for the corresponding visa at the competent Spanish consular office.

The visa stage normally involves documentation such as:

  • valid passport;
  • criminal-record certificate;
  • medical certificate;
  • other consular documentation.

Visa Decision

The Spanish diplomatic mission or consular office generally has an official period of one month to decide the visa application.

Collect the Visa

After approval, the visa must normally be collected personally within one month of notification.

Enter Spain

The visa is normally valid for three months for entry into Spain.

The applicant must enter while the visa remains valid.

Register With Social Security

After entering Spain, the self-employed worker must complete the applicable affiliation, registration and contribution procedures with Spanish Social Security.

Under the current initial procedure, the applicant has up to three months from entry for the corresponding Social Security affiliation and registration to take place.

Apply for the TIE

After Social Security registration, the foreign worker generally has one month to request the physical Tarjeta de Identidad de Extranjero.

EX-07 Does Not Replace the TIE

These documents have different purposes.

Can You Change Your Business Activity During the Initial Year?

The initial authorization is connected to a particular sector of activity.

A material change in the nature of the business should therefore be assessed before it is made.

For example, receiving approval for one professional activity does not automatically mean the applicant can immediately abandon it and start an unrelated business in another sector.

The permitted scope becomes much more flexible after a qualifying renewal.

What Are the EX-07 Renewal Requirements?

  • continued economic activity;

  • compliance with Social Security obligations;

However, continuation of exactly the same business is not the only possible renewal scenario.

Renewal can potentially be possible where a qualifying family member has sufficient economic resources to reunify the self-employed worker under the applicable family rules.

The family relationship and economic resources must be documented.

Protection for Cessation of Activity

A self-employed person receiving qualifying protección por cese de actividad may also have a recognized renewal basis.

This is important because a temporary failure or closure of the original business does not automatically mean that renewal is impossible.

Economically Dependent Self-Employed Workers

Special rules apply to qualifying trabajadores autónomos económicamente dependientes where the relevant contract is interrupted or terminated for reasons outside their control.

A qualifying renewed self-employed residence/work authorization generally permits:

  • self-employed work;
  • employed work;
  • activity anywhere in Spain;
  • work in any sector.

This removes the ordinary initial geographic and sector restrictions.

The difference is significant:

Initial authorization:
Self-employed + Autonomous Community + sector

Renewed authorization:
Employed or self-employed + all Spain + any sector

Can You Become an Employee After EX-07 Renewal?

Yes.

A renewed authorization generally permits both:

  • trabajo por cuenta propia; and
  • trabajo por cuenta ajena.

This means a person who originally arrived as a self-employed worker can potentially accept qualifying employment after renewal without being limited exclusively to autónomo activity by that renewed authorization.

Does EX-07 Lead to Long-Term Residence?

EX-07 can form part of a longer lawful residence history in Spain.

After meeting the applicable residence requirements, a foreign national may eventually qualify for long-term residence.

That is a separate immigration status and should be assessed independently.

The existence of a four-year renewal does not mean long-term residence is automatically granted.

Tax and Social Security After EX-07 Approval

Immigration approval is only one part of becoming self-employed in Spain.

The person may also need to coordinate:

  • Social Security registration;
  • RETA registration;
  • tax registration;
  • invoicing;
  • VAT where applicable;
  • personal income tax;
  • quarterly filings;
  • annual filings;
  • accounting;
  • business licences.
