The Gateway is Closing: UGE Imposes 3-Month Registration Rule for Freelance Digital Nomads

If you are planning to apply for Spain’s Digital Nomad Visa as a freelancer, you need to throw out the old playbook. The UGE (Unidad de Grandes Empresas) has fundamentally shifted its review criteria behind the scenes, and it has completely changed the timeline required for a successful submission.

Historically, applicants operating as independent contractors or service providers could loosely present themselves as “freelancers” simply by showing active service agreements and recent bank deposits. Today, that flexibility is gone.

The UGE now enforces a strict, unwritten policy: if you do not apply as a salaried, W-2 style employee of a single foreign company, you must prove you hold an official business registration in your home country.

The New Standard: No Registration, No Visa

The immigration office is no longer accepting applicants who are “just freelancing” on paper without a formal legal framework.

To be considered for approval under the self-employed track, you must provide official state documentation demonstrating that you are formally registered as an individual entrepreneur, sole proprietor, autónomo, or the exact self-employed equivalent in your country of origin.

If your file lacks this formal corporate registration certificate, the UGE will not give it a pass. Your application will either face an immediate outright rejection or a grueling request for additional information (requerimiento) that can stall your relocation indefinitely.

The Most Costly Mistake: The “Instant Registration” Trap

Understanding that you need an active registration is only half the battle. The most critical element—and the trap that is currently causing a massive wave of rejections—is timing.

The UGE’s Control Unit now explicitly requires that your self-employed or entrepreneur status must have been legally active for at least 3 months at the exact moment your application is submitted.

🛑 The Failure Pattern: Many aspiring nomads discover the registration requirement, rush to open a local sole-proprietor entity or LLC, and submit their Spanish visa application days later. This results in a swift, automated rejection. The UGE tracks your entity’s launch date, and if it lacks the mandatory three months of baseline maturity, your file is deemed non-compliant.

The Correct Compliance Logic

Because the Digital Nomad Visa has evolved from a fast-track entry loop into a highly structured immigration process, your preparation schedule must adjust. If you are a freelancer planning your move to Spain, your preparation roadmap must strictly follow this chronological sequence:

The Preparation Roadmap

1.Formalize Your Business Entity:Month 1.

Register formally as a self-employed professional, sole proprietor, or independent contractor with your home country’s tax and corporate registries. Secure your official certificate of registration.

2.Build a Verifiable Paper Trail:Months 1–3.

Operate through this newly registered entity for a minimum of 90 days. Issue official, sequential invoices (facturas) to your international clients under this business name and ensure all incoming client payments flow cleanly into a matching business bank account.

3.Compile and Submit to the UGE:Month 4.

Once your business registration has crossed the 3-month maturity line, gather your flawless 3-month history of matching bank statements, invoices, and service contracts, and officially log your residency application with Spain.
