Non-Lucrative Visa (NLV)

The Non-Lucrative Visa (NLV) remains one of the most popular pathways for non-EU/EEA citizens seeking to reside in Spain without engaging in professional or economic activities. Designed primarily for retirees, individuals with passive income, or those looking to take a sabbatical, the NLV allows holders to live in Spain while enjoying its high quality of life.

What is the Non-Lucrative Visa?

The NLV is a temporary residence visa that permits you to live in Spain for an initial period of one year. After this period, it can be renewed for subsequent two-year blocks, eventually leading to permanent residency after five years of continuous legal stay.

Key Constraint: As the name implies, holders of this visa are strictly prohibited from working for a Spanish company or being self-employed within Spain. The focus must be on living off existing financial means.

Core Requirements

To be eligible for the NLV, you must meet several specific criteria, with financial stability being the most critical factor.

1. Financial Means

You must demonstrate that you have sufficient funds to support yourself (and any accompanying family members) during your stay without needing to work. The Spanish government uses the IPREM (Indicador Público de Renta de Efectos Múltiples) as a benchmark.

  • Principal Applicant: You generally need to show monthly income or savings equivalent to 400% of the current IPREM.
  • Family Members: Additional funds are required for each family member included in the application.

2. Private Health Insurance

You are required to have comprehensive private health insurance provided by an entity authorized to operate in Spain. The policy must:

  • Have no co-payments or deductibles.
  • Provide coverage equivalent to the Spanish public health system.

3. Clean Criminal Record

You must provide a background check from your country of residence (and any country lived in the past five years), legalized with an Apostille or authenticated, and accompanied by a sworn translation into Spanish.

4. Medical Certificate

A medical report confirming that you do not suffer from any diseases that could pose a threat to public health under the International Health Regulations.

The Application Process

  1. Preparation: Gather all documentation, including proof of financial means, medical certificate, criminal record, and insurance, ensuring they are properly apostilled and translated.
  2. Consular Submission: You must apply at the Spanish Consulate or Embassy that has jurisdiction over your place of residence.
  3. Processing Time: While timelines vary, you can typically expect a decision within one to three months.
  4. Visa Issuance: Once approved, you will receive a visa in your passport, usually valid for 90 days, which acts as your entry permit.
  5. TIE Card: Upon arrival in Spain, you have one month to register your residency and apply for your TIE (Tarjeta de Identidad de Extranjero), which is your physical residence card.

Important Considerations

  • Tax Residency: Spending more than 183 days per year in Spain typically makes you a tax resident. It is vital to consult with a tax professional to understand your obligations regarding global income, assets, and the “Beckham Law” if applicable.
  • Passive Income: While you cannot work, you are generally allowed to manage personal investments, receive rental income, or collect pension payments.
  • Flexibility: The NLV is an excellent “stepping stone.” Many people eventually transition from an NLV to a work-related residency permit if their circumstances change and they decide to pursue professional activities in Spain.
