Many parents in Spain are unaware that their children can obtain an independent residence permit (VNP) that is decoupled from their parents’ legal status. Since 2025, this procedure has been formalized under updated regulations, making it an essential tool for families planning to switch residency types or seeking to simplify their future renewal processes.
What is an Independent Residency Permit for Children?
Under the new regulations (Artículo 160), children who have lived in Spain continuously for at least two years can apply for an individual temporary residence permit valid for five years. In practice, this procedure is successfully applied even to children who were originally granted residency through family reunification.
Why Is This Important?
Transitioning a child to an independent residency permit offers several strategic advantages:

Another significant benefit is that the application is processed by the Oficina de Extranjería. If documents are missing, the office is required to issue a formal request for additional information (requerimiento) rather than denying the application outright. The average processing time is approximately one month.
Requirements for Parents and Families
To be eligible, the following criteria must be met:
- Legal Status: Parents must hold a valid residence permit in Spain.
- Financial Stability & Housing: Proof of sufficient financial means and proof of suitable housing.
- Education: If the child is of school age, proof of enrollment and attendance is mandatory.
Financial Thresholds (based on IPREM):
- 150% of the IPREM for one parent + one child.
- +50% of the IPREM for each additional family member.
Note: Private health insurance is not required for this specific procedure.
Proving Residency: The Crucial Step
The main condition is proving continuous residence in Spain for at least two years. It is recommended to organize proof of residency on a month-by-month basis. Acceptable documentation includes:
- Certificates from schools or daycare centers.
- Medical records and doctor’s appointment logs.
- Receipts for extracurricular activities, sports, or clubs.
- Public transport card records, travel tickets, or event attendance.
- Any other documentation verifying regular presence in the country.
Basic Document Checklist
- Child’s passport (all pages).
- Birth certificate (must be apostilled and officially translated).
- Padrón (proof of registration/residency).
- Evidence of 2+ years of continuous residence.
- Parental documents (passport, NIE/TIE).
- Proof of income and a housing suitability report.
- School/daycare enrollment certificate.
- Completed form EX-01.
- Proof of payment for fee Modelo 790–052.
- Recent passport-sized photographs of the child.
Important: All foreign documents must be apostilled and translated into Spanish by an official sworn translator (traductor jurado).
